FULL RULES

1. SPONSOR:   “Freixenet 150^th Anniversary” Trips to Barcelona, Spain and Bouquets Contest (the “Contest”) is sponsored by Freixenet SA (the “Sponsor”).  The provincial liquor agencies are not connected with the Contest in any manner whatsoever, and are not liable in any way whatsoever in regard to any matter which relates to the Contest.
2. CONTEST PERIODS:  The Contest begins at 12:01 a.m. (Eastern) on January 1, 2011  and (a) in respect of entries for the grand prize draws, ends at 11:59 a.m. (Eastern) on June 30, 2011 and (b) in respect of entries for the final set of monthly secondary prize draws, ends at 11:59 p.m. (Eastern) on December 31,  2011.   The sole determination of times and deadlines for the Contest shall be Sponsor’s network equipment.
3. ELIGIBILITY: The Contest is open to legal residents of Canada (excluding Quebec) who have reached the age of majority* in their province or territory of residence as of January 1, 2011.  Entrants must be legal drinking age to participate.  The Contest is not open to employees and those domiciled with employees of the Sponsor, or any of its parent, subsidiary or affiliated companies, licensees, advertising and promotional agencies (“Related Parties”).  Also, employees and contractors of the provincial liquor agencies, liquor licensees, their employees and members of the immediate families or of the aforementioned or persons with whom they are domiciled are not eligible.  For the purposes of these Contest rules (“Rules”), “immediate family” means a spouse, parent, sibling or child, whether or not they reside in the same household.  The Sponsor reserves the right to verify the age of potential prize winners and that such persons are not employees (or domiciled with employees) of any Related Parties or of any provincial liquor agencies or liquor licensees. 

*Note: The age of majority is 19 years in British Columbia, New Brunswick, Newfoundland, Northwest Territories, Nova Scotia, Nunavut and Yukon Territories and 18 years in Alberta, Manitoba, Ontario, Prince Edward Island, and Saskatchewan.

1. HOW TO ENTER:  No purchase necessary. To enter, go to www.facebook.com/freixenetCA  and complete the online Contest entry form which requires you to submit your name, age, email address, residential address and telephone number and to answer three questions. The Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook®.  You are providing your information to the Sponsor, not to Facebook®.  All information requested by and supplied by each entrant must be truthful, accurate, and in no way misleading.  The Sponsor reserves the right to disqualify any entrant from the Contest in its discretion, should the entrant at any stage supply untruthful, inaccurate, or misleading details and/or information or should the entrant be ineligible for the Contest pursuant to these Rules.  Limit of one entry per day per person.  Each entry must be from your email address.   In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant.  The “authorized account holder” is the individual assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The selected entrant may be required to show proof of being the authorized account holder.   All entries become the property of the Sponsor, none will be returned and no correspondence will be entered into except with selected entrants who will be notified by telephone or e-mail.  Entries are subject to verification and will be declared invalid if they are illegible, incomplete, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way.   

2. 5.     CONDITIONS OF ENTRY:   By entering the Contest you: 

(a)  Rules:  accept the Rules and the decisions of the Sponsor regarding the Contest which shall be final and binding in all respects; 

(b)  Privacy Consent:  consent to the Sponsor’s collection, use and disclosure of your personal information to any third party for the purposes of administering the Contest.  To the extent permitted by law, upon entering into this Contest, you also agree to the Sponsor’s use of your personal information as described in its privacy policy; 

(c) Publicity Consent:  consent to the use of your name, age, city and province, photograph, and likeness in any publicity related to the Contest carried out by the Sponsor, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, unless prohibited by law;  and

(d)  Release and Indemnity: release and hold harmless the Sponsor and Facebook, Inc. and their respective affiliated and related companies and advertising and promotion agencies and their respective directors, officers, shareholders, employees, agents, successors and assigns of any and all of the foregoing (collectively, the “Releasees”) from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the Contest or any prize won.  None of the Releasees accept any responsibility for loss, damage or claims caused by the prizes or the Contest itself.

1. PRIZES AND DRAWS:  At the start of the Contest, the prizes available to be won are as described below.  The chance of winning a prize depends on the number of eligible entries received.  There is a limit of one grand prize and one secondary prize per entrant.   You remain eligible for the grand prize draw even if you win a secondary prize.  All prizes are non transferable and non-refundable.  The winner is not entitled to the monetary difference between actual prize value and stated approximate prize value, if any.  No substitutions or transfers of prize by winner are permitted. The Sponsor reserves the right to substitute prizes (in whole or in part) of equal or greater value, at its sole discretion.

A.  GRAND PRIZES AND DRAWS: There are 4 grand prizes available to be won each consisting of a return trip for 2 persons (3-days/4-nights) to Barcelona, Spain allocated regionally in Canada as follows:  1 for Ontario (ON), 1 for all provinces west of Ontario and all territories (West), 1 for all provinces east of Ontario except Quebec (East) and 1 for Nova Scotia (NS). The Contest ends for grand prizes at 11:59 pm (Eastern) on June 30, 2011.  The draws for grand prizes will be held at approximately 10 a.m. (Eastern) on July 4, 2011.  The grand prize trips must be taken by November 1, 2011 or else will be forfeited.  Each winner and their travel companion must be of legal drinking age.  Each grand prize trip consists of the following:

-  return economy airfare for the winner and their travel companion from the Canadian international airport nearest the winner’s residence to Barcelona, Spain;

-   economy hotel accommodation for two in Barcelona, Spain, includes breakfast;  and

-   guided tour and lunch for two at the Freixenet Cava Winery near Barcelona (includes transfers to and from hotel).

The approximate retail value (“ARV”) of each grand prize is $5,000 based on Toronto departure.  The actual value of the grand prize depends on point of departure and fluctuation of hotel, airfare and currency rates among other things. Flights and hotel are to be determined at the sole discretion of the Sponsor and are subject to availability.  The winner or their travel companion must give a valid credit card at hotel check-in for incidentals (and damages). Air tickets are not valid for frequent flyer mileage. The Sponsor reserves the right, in its sole discretion, to substitute and/or modify the grand prize or a component of the grand prize with a prize of equal or greater value if the grand prize or any component thereof should become unavailable for any reason. In the event that a winner is unable to redeem any or all of the grand prize components due to reasons beyond the control of the Sponsor, no compensation or substitution grand prize or grand prize component will be provided.

NOT INCLUDED IN GRAND PRIZE: The grand prize does not include anything not explicitly set forth in the grand prize description above, including without limitation: transportation to and from airports, additional ground transportation, upgrades to premium classes, mileage redemption, in-flight air-to-ground telephone calls, pre- and post- overnight layover hotel accommodations, car rentals, personal and miscellaneous expenses of any kind, medical, health, hospital and trip cancellation insurance, airport or other taxes and fees, food and beverages (alcoholic or otherwise), sightseeing, merchandise or souvenirs, entrance, admission or other fees or any costs or expenses of or related to the obtaining of necessary travel documents. The grand prize must be accepted as awarded without substitution and is not transferable or redeemable for cash or allowed to be sold. 

No changes will be made to travel details once any portion of the travel arrangements have been confirmed.  The grand prize winner and their travel companion must (a) depart from the same airport and travel on the same itinerary,  (b)  be legally able to travel and (c) hold and present a valid passport to travel by airplane to Spain.  The Sponsor will not be responsible for risks associated with air travel, international holiday, weather and quality of service provided by the airline or hotel staff and management.  The Sponsor will not be responsible for any expenses or arrangements to return the winner and/or their travel companion to the point of origin or elsewhere.  Any tickets, passes or coupons issued in connection with the grand prize, including but not limited to airline tickets, that are lost, stolen or destroyed will not be replaced.   Credit for previous purchases is not permitted. All tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. In addition, the winner and their travel companion are responsible for any federal, provincial, and local tax consequences and for compliance with all governmental reporting and payment requirements.

B.  SECONDARY PRIZES AND DRAWS:  There are 450 secondary prizes available to be won each consisting of a bouquet of 6 white long stem roses, ARV $42.50 allocated regionally in Canada as follows:  150 for ON, 150 for West and 150 for East. The Contest starts on January 1, 2011 and ends for secondary prizes at 11:59 pm (Eastern) on December 31, 2011 (the “Secondary Prize Contest Period”). The draws for secondary prizes will be held monthly during the first week of  the month for the immediately preceding month (12 draws/month for each of ON, West and East for every month of the Secondary Prize Contest Period with an additional 6 draws in December – i.e., in total 18 draws for December in each of ON, West and East.

1. QUALIFYING SELECTED ENTRANTS AS WINNERS:  Before being declared a winner, the selected entrant must correctly answer a time-limited mathematical skill-testing question without assistance, or mechanical or electronic aid, and will be required to sign a declaration of compliance and release of liability (the “Declaration and Release”) in the Sponsor’s standard form confirming compliance with the Rules and acceptance of any prize as awarded.   The selected entrant will be notified by telephone or email on or about July 5, 2011. Three attempts at contact will be made to each selected entrant by means of Sponsor’s choosing. If a selected entrant cannot be contacted within 5 days of their name being randomly drawn, then an alternative selected entrant will be drawn at random. Selected entrants will be asked to submit their complete address to verify their residence and may be asked to submit identification before being declared winners. To receive their prize vouchers, selected entrants and, in the case of grand prize winners their travel companions, must comply with section 9 of the Rules below.  The return of any prize/prize notification as undeliverable or noncompliance with the terms of these Rules may result in disqualification and at the Sponsor’s discretion, selection of another Contest entrant.
2. SECOND AND THIRD CHANCES FOR SKILL-TESTING QUESTION:  The Sponsor will provide a selected entrant of the grand prize who has answered the skill-testing question incorrectly or not within the time allotted, with the opportunity to correctly answer a second (and if necessary third), different skill-testing question.  If the second and third question are answered incorrectly or not within the time allotted, the grand prize is forfeited and will be made available to be won by another Contest entrant.
3. DECLARATION AND RELEASE: Each selected entrant will be required to execute and return a Declaration and Release within 5 days of attempted delivery or prize will be forfeited and may be awarded to another Contest entrant. The Declaration and Release shall include terms confirming eligibility and compliance with the Rules, and releasing the Sponsor, its advertising and promotional agencies, any Contest judging organization, provincial liquor authorities, parent companies and affiliates of the foregoing, and all their respective directors, officers, owners, partners, employees, agents, representatives, successors and assigns from any and all claims, liabilities, losses, damages or expenses of any kind in arising from or in connection with the Contest, or arising as a result of or in connection with any prize being awarded.  The winner’s travel companion must also execute a Declaration and Release prior to the grand prize being awarded.
4. MORE WINNERS THAN ANTICIPATED: If, as a result of an error relating to the entry process, drawing or any other aspect of the Contest, there are more potential winners of prizes than contemplated in these Rules, there will be a random draw amongst all eligible prize claimants to award the correct number of prizes.
5. LIMITATION OF LIABILITY: The Sponsor shall not be liable for lost, late, incomplete, misdirected, not received, stolen, mutilated, or illegible entries, prize notifications, or Declarations and Releases. The Sponsor shall not be responsible for any failure of the Contest platform or website or any wireless network failure during the Contest or for any problems or technical malfunction of a telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail, on-line, or Internet entry to be received by the Sponsor. In addition, the Sponsor shall not be responsible due to technical problems, traffic congestion on the Internet or at any website or wireless network, or any combination thereof including any injury or damage to an entrant's or any other person's computer, or property related to or resulting from playing or downloading any material in the Contest. The Sponsor reserves the right, at their sole discretion to cancel or suspend this Contest should a virus, bug or any other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
6. WINNER’S LIST: The names of the Contest winners will be posted at www.facebook.com/freixenetCA  once they have been qualified and have returned a signed Declaration and Release.
